The Party Central Committee has decided to establish the Central Committee for the comprehensive rule of law, which is the first time in our party's history. The purpose is to strengthen the party's centralized and unified leadership over the comprehensive rule of law, and to promote the comprehensive rule of law as a whole.

1、 Fully understand the significance of the establishment of the Central Committee for the overall rule of law

Since the 18th National Congress of the Communist Party of China, I have attached great importance to the rule of law and talked a lot. At present, our country is in the historical intersection period of achieving the two centenary goals. To adhere to and develop socialism with Chinese characteristics, we need to rely more on the rule of law, and more importantly, strengthen the party's leadership over the overall rule of law. The Party Central Committee has decided to establish the Central Committee for the comprehensive administration of state affairs according to law, which mainly includes the following considerations.

First, it is necessary to implement the spirit of the 19th National Congress of the Communist Party of China and strengthen the party's centralized and unified leadership over the overall rule of law. The Fourth Plenary Session of the 18th Central Committee of the Communist Party of China formulated the top-level design, road map and construction drawing to promote the comprehensive rule of law. The 19th National Congress of the Communist Party of China put forward a new task to promote the comprehensive rule of law in the new era. It is clear that by 2035, the country, government and society under the rule of law will be basically completed. In order to better implement these objectives and tasks, the Party Central Committee listened to the opinions and suggestions of all parties and decided to establish the Central Committee for the comprehensive rule of law. The establishment of this committee is to improve the system and working mechanism of the party's leadership in running the country in an all-round way in accordance with the law, strengthen the leadership of the Party Central Committee in scientific legislation, strict law enforcement, fair justice and law-abiding of the whole people, and more effectively promote the implementation of the decision-making and deployment of the Party Central Committee.

I have repeatedly talked about the relationship between the party's leadership and the rule of law. To promote the institutionalization and legalization of the party's leadership is not only the proper meaning of strengthening the party's leadership, but also an important task of the construction of the rule of law. Why can China maintain long-term stability without chaos? The fundamental one is that we always adhere to the leadership of the Communist Party. The party's leadership is the "sea god needle" for the continuous development of the cause of the party and the state. On the basis of confirming the leading position of the party in the preamble of the constitution, we clearly stipulated in the general outline that the leadership of the Communist Party of China is the most essential feature of socialism with Chinese characteristics, and strengthened the leading position of the party in commanding the overall situation and coordinating all parties. After the amendment of the constitution, the response was very good. We should continue to promote the institutionalization and rule of law of the party's leadership, constantly improve the party's leadership system and working mechanism, and implement the party's leadership throughout the whole process and all aspects of the rule of law.

Only when the party is run in accordance with the rules and regulations and the country is run in accordance with the law can the people's heart be deepened. Since the 18th National Congress of the Communist Party of China, we have formulated and revised more than 140 laws and regulations of the Central Committee of the Communist Party of China, introduced a number of landmark, critical and basic laws and regulations, basically solved the problems that can be relied on by regulations, and the next step is to strictly enforce the regulations, so that the laws and regulations of the party can be truly implemented. Most of the fallen officials confessed that they did not understand party discipline and national law. Why are so many senior cadres in the party on the road of crime? The fundamental reason lies in the wavering of ideals and beliefs, but the lack of awe for Party discipline and national law is also an important reason.

Second, it is necessary to study and solve major issues and problems in governing the country according to law, and to coordinate and promote the socialist legal system with Chinese characteristics and the construction of a socialist country ruled by law. It is a long-term and important historical task to run the country in an all-round way according to law, as well as a profound social change. At present, there are many weak links in legislation, law enforcement, judicature, law-abiding and other aspects. The reform in the field of rule of law is faced with many hard bones, so it is urgent to strengthen overall coordination from the level of the Party Central Committee.

To implement the new development concept and realize the transformation of economy from high-speed growth to high-quality development, we must adhere to the rule of law as the guide. In terms of the relationship between development and the rule of law, there are still misunderstandings in some places that "development should go up and the rule of law should let go". Last year, the Party Central Committee dealt with the ecological environment of Qilian Mountain National Nature Reserve in Gansu Province, and a number of Party and government cadres were punished. The regulations on the administration of Qilian Mountain National Nature Reserve in Gansu Province has been amended for three times. Some provisions are always inconsistent with the regulations of the people's Republic of China on nature reserves. Only by "releasing water" in legislation and "giving up" in law enforcement, can Qilian mountain ecosystem be seriously damaged. Such lessons must be learned in depth.

The foundation of the party lies in the people and its strength lies in the people. Now, people's yearning for a better life is more extended to democracy, rule of law, fairness, justice, security, environment and other aspects. The people's opinions on the disorderly act and omission of law enforcement as well as judicial injustice are relatively concentrated, which should be the focus and driving point for us to enforce the rule of law. For example, some black and evil forces have been engaging in such illegal activities as mob building, monopoly management, extortion and Casino opening for a long time, and the common people dare not to be angry. How can the black and evil forces develop from small to large under our eyes? I think there is a situation in which law enforcers are willing to let them do nothing. Some local law enforcement departments even collude with the black and evil forces to act as a protective umbrella. The law enforcement department represents the interests of the people and must not be the umbrella of the family forces and the black and evil forces. In recent years, the judicial organs have corrected a number of unjust, false and wrong cases, such as the hugejile pattern, the Nie Shubin case and the nianbin case, which have been praised by the masses. There are many reasons for the unjust cases, including the lack of basic judicial conscience and responsibility of judicial personnel, the deeper level is the unscientific allocation of judicial power and power operation mechanism, and the system mechanism of mutual restriction of investigation power, procuratorial power, judicial power and executive power has not really formed. The reason behind the recent Changsheng vaccine fraud in Changchun is that there are laws that are not abided by, the law enforcement is not strict, and the laws and regulations are taken seriously. This requires us to promote strict norms, fair and civilized law enforcement, so that the people really feel that fairness and justice are around us.

China must be good at using the rule of law when going to the world and participating in international affairs as a responsible power. In the foreign struggle, we should take up the legal weapons, occupy the commanding heights of the rule of law, and dare to say no to the saboteurs and troublemakers. The global governance system is in a critical period of adjustment and change. We need to actively participate in international rule-making and become participants, promoters and leaders in the process of global governance change.

Third, it is necessary to promote the realization of the "two centenary goals" and provide legal guarantee for the realization of the Chinese dream of the great rejuvenation of the Chinese nation. History and reality tell us that the prosperity of the country depends on the rule of law, while the strength of the country depends on the rule of law. In ancient China, every flourishing age is a period of relatively sound legal system. During the spring and Autumn period and the Warring States period, Legalists advocated "rule by law" and practiced it in the state of Qin in Yongzhou. Shang Yang "set up a tree to build trust" and emphasized that "law must be clear and order must be followed", which made the state of Qin quickly become one of the powerful countries, and finally led to the unification of the six states by the first emperor of Qin. Liu Bang, the emperor of the Han Dynasty, and the common people in Guanzhong, made "three rules" and played an important role in ruling the country. There were 60 laws of the Han Dynasty formed during the reign of Emperor Wu of the Han Dynasty, which were used for nearly 400 years. Emperor Taizong of Tang Dynasty regards the law as the most important part of governing the country, one of the laws of Zhenguan has achieved "the rule of Zhenguan", and the revised version of the laws of Tang Dynasty based on the laws of Zhenguan has laid a legal foundation for the prosperous age of Tang Dynasty. From the perspective of world history, the prosperity of a country is often accompanied by the rule of law. More than 3000 years ago, when Hammurabi, the king of Babylon, came to the throne, he unified the national law, formulated the Hammurabi code, the first written law in human history, and engraved its provisions in stone pillars, thus promoting the kingdom of Babylon to enter the heyday of the ancient two river basins. The famous German jurist Jenin said that the Roman Empire conquered the world three times, the first time by force, the second time by religion, the third time by law, force died out because of the fall of the Roman Empire, religion shrank its influence with the improvement of people's ideological awareness and the development of science, but the legal conquest of the world is the most lasting conquest.

Since modern times, the people with lofty ideals in China have also realized this problem. Since the reform movement of 1898 and the revision of the law in the late Qing Dynasty, the Chinese people have been calling for the legal system. However, under the historical and political conditions at that time, the social nature of the old China and the tragic fate of the Chinese people could not be changed by the legal system alone. Our party has been in power for more than 60 years. Although it has experienced setbacks, it has been committed to the rule of law. From the May 4th constitution to the newly revised constitution, from the socialist legal system to the socialist legal system, from the laws to be obeyed, the laws to be obeyed, the laws to be strictly enforced, and the laws to be prosecuted, to the scientific legislation, strict law enforcement, fair justice and law-abiding of the whole people, our party has realized more and more deeply By now, the rule of law is indispensable for governing the country.

In a word, whether it is to achieve the two centenary goals or to realize the Chinese dream of the great rejuvenation of the Chinese nation, a comprehensive rule of law is not only an important content, but also an important guarantee. We put the rule of law into the "four comprehensive" strategic layout, which is to provide long-term and stable legal guarantee for building a moderately prosperous society in an all-round way, deepening reform in an all-round way and running the party strictly in an all-round way. I have repeatedly stressed that in the "four comprehensiveness", the comprehensive rule of law plays a fundamental and protective role. In the new journey of promoting the great struggle, the great project, the great cause and the great dream as a whole and building a socialist modern country in an all-round way, we need to give better play to the role of the rule of law as a guarantee to consolidate the foundation, stabilize expectations and benefit the long-term.

2、 Adhere to the guidance of the new concept, new thought and new strategy of comprehensively governing the country by law, and unswervingly follow the road of socialist rule of law with Chinese characteristics.

Since the 18th National Congress of the Communist Party of China, the Central Committee of the Communist Party of China has made a series of major decisions and put forward a series of major measures to comprehensively govern the country according to law. We have adapted to the development requirements of the party and the state, improved the legislative system, strengthened legislation in key areas, and gradually improved the socialist legal system with Chinese characteristics. We adhere to the rule of law in accordance with the constitution, revise the Constitution with the times, establish a national constitution day, establish a constitutional oath system, and comprehensively strengthen the implementation and supervision of the constitution. We will promote the construction of a government under the rule of law, significantly reduce matters of administrative examination and approval, completely terminate non administrative examination and approval, establish a list of government powers, negative lists, and responsibility lists, standardize administrative power, and promote strict, fair and civilized law enforcement. We will unswervingly promote reform in the field of the rule of law, abolish the system of reeducation through labor, promote the reform of the judicial responsibility system, the post system and the trial centered criminal procedure system, correct a number of major cases of injustice, falsehood and error according to law, and significantly improve the quality, efficiency and credibility of justice. We adhere to the basic work of law-abiding and law-abiding as the rule of law, implement the responsibility system of law-abiding of the state organs "who enforces the law, who popularizes the law", integrate the education of rule of law into the national education system, and obviously enhance the concept of rule of law in the whole society. We should promote the construction of the legal team, develop and strengthen the legal service team, and strengthen legal education and the cultivation of legal talents. We adhere to the rule of law, strengthen the construction of laws and regulations within the party, promote the reform of the national supervision system, punish corruption crimes in accordance with the law, and achieve outstanding results in comprehensively and strictly governing the party.

Since the eighteen National Congress of the Communist Party of China (CPC), we have put forward a series of new ideas, new ideas and new strategies for the comprehensive rule of law, and defined the guiding ideology, development path, work layout and key tasks of the comprehensive rule of law. In summary, there are the following 10 aspects.

First, adhere to strengthening the party's leadership over the rule of law. The leadership of the party is the most fundamental guarantee of the socialist rule of law. The overall rule of law is not to weaken the party's leadership, but to strengthen and improve the party's leadership, constantly improve the ability and level of the party's leadership in the rule of law, and consolidate the party's ruling position. We must adhere to the realization of the party's leadership in legislation, guarantee law enforcement, support justice, take the lead in abiding by the law, improve the system and working mechanism of the party's leadership in comprehensively governing the country in accordance with the law, make the party's claims become the will of the state and form laws through legal procedures, guarantee the effective implementation of the party's policies through laws, and ensure the correct direction of comprehensively governing the country in accordance with the law.

Second, adhere to the people's dominant position. The construction of the rule of law should serve, rely on, benefit and protect the people. We must firmly grasp the pursuit of social fairness and justice, the value of the rule of law, and strive to make the people feel fairness and justice in every legal system, every decision of law enforcement and every judicial case. We should implement the whole process of governing the country in accordance with the law that embodies the interests of the people, reflects the wishes of the people, safeguards the rights and interests of the people, and promotes the well-being of the people, and ensure that the people, under the leadership of the party, manage state affairs, economic and cultural undertakings, and social affairs through various channels and forms.

Third, adhere to the socialist road of rule of law with Chinese characteristics. We must take the right path to comprehensively promote the rule of law. We should proceed from China's national conditions and reality, take the road of rule of law suitable for ourselves, never copy the models and practices of other countries, and never follow the road of "constitutionalism", "three powers" and "judicial independence" in the West.

Fourth, adhere to the construction of the socialist legal system with Chinese characteristics. The legal system of socialism with Chinese characteristics is the legal manifestation of the system of socialism with Chinese characteristics. We must seize the general grasp of the construction of the socialist legal system with Chinese characteristics, strive to form a complete legal system, an efficient system for the implementation of the rule of law, a strict system for the supervision of the rule of law, a strong system for the protection of the rule of law, a sound system of laws and regulations within the party, and constantly create a new situation of the rule of law in all aspects.

Fifthly, we should adhere to the rule of law, the rule of law and the administration according to law, and build a country under the rule of law, a government under the rule of law and a society under the rule of law. It is a systematic project to run the country in an all-round way according to law. We must take overall consideration, grasp key points and plan as a whole, and pay more attention to systematization, integrity and coordination. Ruling the country according to law, ruling by law and administrating according to law are an organic whole. The key lies in that the party should adhere to the rule of law and all levels of government should adhere to the administration according to law. The country under the rule of law, the government under the rule of law and the society under the rule of law have their own emphases and complement each other. The country under the rule of law is the goal of the construction of the country under the rule of law. The government under the rule of law is the main body of the construction of the country under the rule of law, and the society under the rule of law is the foundation of the construction of the. We should be good at using systems and laws to govern the country, and improve the level of scientific, democratic and legal governance of the party.

Sixthly, we should adhere to the principle of governing the country according to the constitution. To run a country according to law, we must first adhere to the constitution, and to run a country according to law, we must first adhere to the constitution. The party leads the people to make constitutional laws and lead the people to implement them. The party itself must act within the scope of constitutional laws. All citizens, social organizations and state organs must take the Constitution and law as the code of conduct, exercise their rights or powers, perform their obligations or duties in accordance with the Constitution and law, and shall not have the privilege of exceeding the Constitution and law, and all acts in violation of the Constitution and law must be investigated.

The seventh is to adhere to the principle of comprehensively promoting scientific legislation, strict law enforcement, fair justice and law-abiding by the whole people. To solve the outstanding contradictions and problems in the fields of legislation, law enforcement, justice and law-abiding, we must unswervingly promote the reform in the field of rule of law. We should firmly grasp the key link of the overall rule of law, improve the legislative system and improve the quality of legislation. We should promote strict law enforcement, rationalize the law enforcement system, improve administrative law enforcement procedures, and fully implement the responsibility system for administrative law enforcement. We should support the judicial organs to exercise their functions and powers independently according to law, and improve the institutional arrangements for the division of responsibilities, mutual cooperation and mutual restriction of judicial power. We need to increase the efforts of law popularization by the whole people, and foster a legal environment in which the whole society works in accordance with the law, finds ways to solve problems, and resolves conflicts.

Eighth, we should adhere to the dialectical relationship of managing the country in an all-round way according to law. The relationship between politics and the rule of law, reform and the rule of law, the rule of law and the rule of virtue, the rule of law and the rule of law must be correctly dealt with in order to run the country in an all-round way according to law. The socialist rule of law must adhere to the leadership of the party, which must rely on the socialist rule of law. "Reform and the rule of law are like two wings of a bird and two rounds of a car". We should adhere to promoting reform under the rule of law and improve the rule of law in the reform. We should adhere to the combination of rule of law and rule of virtue, and realize that rule of law and rule of virtue complement each other and complement each other. We should give full play to the complementary role of running the country in accordance with the law and regulations, and ensure that the party not only runs the country and administers the party in accordance with the Constitution and laws, but also manages and administers the party in strict accordance with the party's laws and regulations.

The ninth is to adhere to the construction of a high-quality legal work team with both ability and moral integrity. In order to promote the rule of law in an all-round way, we must strive to build a socialist legal work team that is loyal to the party, the country, the people and the law. We should strengthen the education of ideals and beliefs, deepen the education of socialist core values and socialist concept of the rule of law, promote the standardization, specialization and professionalization of the legal professional team, and improve professional quality and professional level. We should adhere to the principle of moral cultivation, combine moral education with law education, innovate the training mechanism of legal talents, and strive to cultivate a large number of high-quality legal talents and reserve forces.

Ten is to stick to the "key minority" of leading cadres. It is the key to rule the country in accordance with the law that the leading cadres exercise the party's power in power, the state's legislative power, administrative power, supervisory power and judicial power. Leading cadres must take the lead in respecting and worshiping the law, understanding and mastering the law, abiding by disciplines and laws, defending the rule of law, enforcing the rule of law and dealing with affairs according to law, constantly improving their ability to deepen reform, promote development, resolve conflicts and maintain stability by using the thinking and methods of the rule of law, being a model of respecting the law and abiding by the law, and driving the whole society to respect the law and abiding by the law with practical actions Law.

These new ideas, new thoughts and new strategies are the latest achievements of Marx 's thought of rule of law in China, and the fundamental follow of the comprehensive rule of law.
